Terms of Service
Welcome to the website and digital portals of GeriPro, Inc. (“GeriPro,” “we,” “us,” or “our”). By accessing or using our website, billing tools, client portals, or services (collectively, the “Services”), you agree to comply with and be bound by these Terms of Service. If you are entering into these Terms on behalf of a Skilled Nursing Facility (SNF) or healthcare provider, you represent that you have the legal authority to bind that entity.
1. Scope of Services
GeriPro provides Medicare Part B supply billing, medical record auditing, and revenue recovery services. These online terms govern your general use of our website. The specific commercial terms of our contingency fee structure, remittance procedures, and billing operations are governed by your fully executed Master Services Agreement (MSA).
2. Healthcare Compliance & HIPAA
- Protected Health Information (PHI): The parties acknowledge that in performing services, GeriPro may receive or have access to PHI subject to the Health Insurance Portability and Accountability Act (HIPAA). All transmission and handling of PHI through our website portals are strictly governed by our Business Associate Agreement (BAA).
- Data Accuracy: You are solely responsible for ensuring that all patient medical records, documentation, and billing logs provided to GeriPro are accurate, complete, and fully compliant with Center for Medicare & Medicaid Services (CMS) documentation rules.
3. Account Security & Authorized Access
If you are issued credentials to access a secure GeriPro billing portal or dashboard:
- You must maintain the strict confidentiality of your username and password.
- You agree to notify GeriPro immediately at remits@geripro.com if you suspect any unauthorized access to your billing portal.
- You may not share credentials across multiple employees; each user must have unique access parameters to maintain compliance.
4. No Guarantee of Government Payouts
While GeriPro uses industry-leading auditing techniques to optimize claims approval, final coverage determinations are governed exclusively by Medicare Administrative Contractors (MACs) and CMS guidelines. GeriPro makes no express or implied warranty regarding the ultimate approval or timing of government payouts.
5. Limitation of Liability
To the maximum extent permitted by law, GeriPro shall not be liable for any indirect, incidental, or consequential damages resulting from claims denials, government audits, or delays. In the event of a post-payment CMS audit or recoupment demand, GeriPro’s total cumulative liability under these website terms shall be strictly limited to the specific contingency fees collected by GeriPro for the individual contested claim in question.
6. Governing Law
These Terms shall be governed by and construed in accordance with federal healthcare regulations and the laws of the State of Arizona, without regard to conflict of law principles. Any legal actions or proceedings arising under these Terms shall be brought exclusively in the state or federal courts located in Arizona.
